1Introduction

Premier Talent ("we," "us," or "our") operates a digital hiring platform connecting employers and jobseekers. We are committed to protecting the privacy of all individuals who interact with our platform, including jobseekers, employers, and general website visitors.

This Privacy Notice is issued in compliance with the Personal Data Protection Act 2010 of Malaysia ("PDPA") and any other applicable data protection legislation. It sets out the basis on which Personal Data collected from or about you will be processed by us.

By accessing or using the Premier Talent platform, you acknowledge that you have read, understood, and agree to the collection, use, and disclosure of your Personal Data as described herein.

2Definitions

Personal Data

Any information that directly or indirectly identifies a living individual, including but not limited to name, NRIC or passport number, contact information, date of birth, employment history, financial information, photographs, and resume data.

Sensitive Personal Data

Personal Data relating to health or medical conditions, religion, criminal records, or biometric data as defined under the PDPA.

Jobseeker

Any individual who registers on the Premier Talent platform for the purpose of seeking employment opportunities.

Employer

Any company, organisation, or individual that registers on the Premier Talent platform for the purpose of sourcing and hiring talent.

Group Companies

The subsidiaries, affiliated entities, and associated companies of Premier Talent, including participating companies during our initial deployment phase.

Platform

The Premier Talent website, web application, and any related digital services operated by us.

3Data Controller

Premier Talent acts as the primary data controller in respect of the Personal Data you provide to us or that we collect in connection with your use of the Platform.

Where a Jobseeker submits an application or their profile is accessed by an Employer through the Platform, Premier Talent and the relevant Employer act as joint data controllers in respect of the Personal Data processed in connection with that application or profile review.

Jobseekers wishing to exercise their data rights in respect of Personal Data held by an Employer should contact that Employer directly. Enquiries regarding this Privacy Notice or the exercise of your rights should be directed to our Data Protection Officer at the contact details provided at the end of this document.

4Categories of Personal Data Collected

Depending on your relationship with us, we may collect the following categories of Personal Data:

Jobseekers

  • Full name, date of birth, gender, and nationality
  • NRIC or passport number
  • Contact details including home address, telephone number, and email address
  • Resume, curriculum vitae, cover letters, and portfolio materials
  • Educational qualifications, certifications, and employment history
  • Profile photograph
  • Interview recordings or responses submitted through our AI-assisted interview tools
  • Job preferences, salary expectations, and availability

Employers

  • Company name, registration number, and business address
  • Contact person's name, job title, email address, and telephone number
  • Billing and payment information
  • Job posting content and hiring criteria

General Website Visitors

  • IP address, browser type, and device information
  • Pages visited, time spent on the Platform, and referral sources
  • Session data

5How We Collect Your Personal Data

  • Directly from you when you register an account, complete your profile, submit a job application, or post a job listing
  • Through automated technologies such as cookies and web beacons when you visit the Platform — please refer to our separate Cookie Policy for further details
  • From employers who provide candidate information in connection with the hiring process facilitated through our Platform
  • When you correspond with us via email, telephone, or other communication channels
  • From publicly available sources where relevant and permitted by applicable law

6Purposes of Processing

For Jobseekers, we process your Personal Data to:

  • Create and manage your account on the Platform
  • Match your profile with relevant job opportunities and notify you of suitable vacancies
  • Facilitate submission of your profile and resume to prospective Employers
  • Enable participation in AI-assisted interview processes through our integrated interview tools
  • Communicate with you regarding your applications, account status, and platform updates

For Employers, we process your Personal Data to:

  • Create and manage your employer account and job listings on the Platform
  • Provide access to candidate profiles and facilitate the shortlisting and hiring process
  • Enable use of AI-assisted interview and candidate evaluation tools
  • Process billing and payment transactions
  • Provide customer support and respond to enquiries

For all users, we process your Personal Data to:

  • Comply with applicable legal, regulatory, and statutory obligations
  • Detect, investigate, and prevent fraudulent activity and security incidents
  • Improve, maintain, and develop our Platform and services
  • Conduct internal analytics for service improvement
  • Send service-related notifications and, where you have consented, marketing communications
  • Establish, exercise, or defend our legal rights

7AI-Assisted Processing

We use artificial intelligence tools to process and analyse Jobseeker profiles and CVs. This processing is used to provide Employers with a holistic overview of candidate suitability and to generate best-fit recommendations.

No hiring decision is made solely on the basis of automated processing. All AI-generated outputs are intended to assist and inform human review by Employers. Final hiring decisions remain the responsibility of the Employer.

8Group Company Access to Candidate Profiles

Premier Talent operates within a group of companies. During our initial deployment phase, your profile and CV data may be made accessible to a defined group of participating companies for the purpose of evaluating your suitability for employment opportunities within the group.

A list of participating companies is available upon request by contacting our Data Protection Officer. You may withdraw your consent for this at any time, and we will action such requests in accordance with our obligations under the PDPA.

9Legal Basis for Processing

Consent

Where you have given explicit consent for specific purposes, including participation in candidate pools or receipt of marketing communications.

Contractual Necessity

Where processing is necessary to perform a contract with you or to take pre-contractual steps at your request.

Legal Obligation

Where processing is required for compliance with a legal or regulatory obligation to which we are subject.

Legitimate Interests

Where processing serves our legitimate business interests and does not override your fundamental rights and freedoms.

10Disclosure of Personal Data

We treat your Personal Data as confidential. However, we may disclose it to the following parties where relevant and necessary:

  • Employers — When a Jobseeker submits an application or their profile is made available through the Platform in the course of the hiring process.
  • Group Companies — Our subsidiaries and affiliated entities, including participating companies during our initial deployment phase, as described in Section 8.
  • Authorised Service Providers — Third-party vendors, technology providers, and subcontractors engaged to support our platform operations.
  • Professional Advisors — Auditors, legal counsel, accountants, and consultants engaged by us.
  • Regulatory and Government Authorities — Government agencies, law enforcement bodies, and statutory authorities, as required by law or in response to lawful requests.
  • Business Transferees — In the event of a merger, acquisition, or sale of assets, your Personal Data may be transferred to the relevant successor entity, subject to equivalent privacy protections.

11Cross-Border Data Transfers

Your Personal Data may be transferred to and processed in countries outside Malaysia, including Singapore, where our technology infrastructure and service providers are located, including cloud hosting and email delivery services.

We implement appropriate contractual and organisational safeguards to ensure your Personal Data remains protected in a manner consistent with the requirements of the PDPA.

12Retention of Personal Data

We retain your Personal Data only for as long as is necessary to fulfil the purposes for which it was collected, or as required by applicable law or regulation. When Personal Data is no longer required, we will securely delete, anonymise, or otherwise dispose of it in an appropriate manner.

13Security of Personal Data

We implement appropriate technical and organisational measures to protect your Personal Data against unauthorised access, disclosure, alteration, or destruction.

In the event of a security incident that poses a material risk to your Personal Data, we will investigate promptly, notify the relevant authorities as required by applicable law, and inform affected individuals as appropriate.

14Your Rights

Subject to the PDPA and applicable laws, you have the following rights in respect of your Personal Data:

Right of Access

To request access to the Personal Data we hold about you.

Right of Correction

To request correction of inaccurate or incomplete Personal Data.

Right to Withdraw Consent

To withdraw previously given consent, without affecting the lawfulness of processing carried out prior to withdrawal.

Right to Limit Processing

To request that we cease or limit the processing of your Personal Data in certain circumstances.

Right to Opt Out of Marketing

To opt out of receiving marketing communications at any time.

15Children's Privacy

Our Platform is not directed at individuals under the age of 18. If you are below 18 years of age, you must obtain the consent of a parent or legal guardian before providing us with your Personal Data.

16Third-Party Links

Our Platform may contain links to third-party websites or services. We are not responsible for the privacy practices of those third parties and encourage you to review their respective privacy policies before providing any Personal Data.

17Updates to This Privacy Notice

We reserve the right to update or amend this Privacy Notice at any time. The revised version will be posted on our Platform with the updated effective date. Your continued use of the Platform following any such update constitutes your acceptance of the revised Privacy Notice.
